1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Comni website and services (the “Service”). By creating an account, signing in, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Description of the Service
Comni provides tools for organizations to build a community, support inbox, announcements, knowledge base, and embeddable chat widget around their product. We may change, suspend, or discontinue features at any time, with or without notice.
3. Accounts
To use the Service, you must create an account with a valid email address, or sign in with a supported provider. You are responsible for:
- Keeping your account credentials confidential;
- All activity that occurs under your account; and
- Ensuring the information you provide is accurate and current.
One person may not maintain multiple free accounts without a legitimate business need. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation;
- Post, transmit, or distribute unlawful, defamatory, harassing, abusive, or hateful content;
- Infringe the intellectual property or privacy rights of others;
- Send spam, phishing messages, or malicious content through the widget or community features;
- Attempt to gain unauthorized access to the Service or other users' accounts; or
- Interfere with or disrupt the operation of the Service.
We may remove content or suspend accounts that violate these Terms.
5. User Content & License
You retain ownership of the content you post to the Service. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display that content as necessary to provide the Service.
You represent that you have the rights to any content you post and that it does not violate the rights of any third party.
6. Subscriptions, Billing & Payments
Paid plans are billed on a recurring basis through Whop. You agree to pay all fees associated with the plan you select. Fees are non-refundable except as required by law. We may change plan fees with reasonable notice.
If a payment fails, we may suspend or cancel your plan. You can cancel your subscription at any time from your Whop billing account; access continues until the end of the paid period.
7. Third-Party Services
The Service integrates with third-party providers, including Supabase, Whop, Google, and GitHub. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
8. Intellectual Property
The Service, including its software, design, logos, and content (other than user content), is owned by Comni or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the Service.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, Comni shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the amounts you have paid us in the twelve months preceding the claim.
11. Termination
You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ends, and we may delete your content in accordance with our Privacy Policy.
12. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where Comni is established, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page and, where appropriate, notified by email. Continued use of the Service after changes take effect means you accept the updated Terms.
